Collusion is never a good way to conduct business.

But there is an important question here:

Who gets to define what counts as sufficiently safe, and could that definition entrench the firms already at the top?

Whether or not this case succeeds is less important than how AI-based companies decide to act in the future: building a silicon wall may have helped before, but the old playbook isn’t working anymore. It’s a different tech, game, and world than it was when social media and search engines hit the scene.

I’ll have more to say later, but this is an interesting case all the same.
